MASON CITY – Michael Young Jr. is back on the streets after sitting in jail for just 60 days after stabbing 54-year-old Ricky DeMaris in the neck on September 22nd.
After having his throat slashed, Ricky DeMaris was able to relay who his attacker was to law enforcement before being taken to the hospital for life threatening injuries. Mason City Police soon apprehended Michael Young JR and transported him to the Cerro Gordo County Jail.
Originally Young was charged with a Class C felony count of Willful Injury – Causing Serious Injury. A trial date had been set for Dec 11th with Young facing 10 years in prison if convicted.
As part of a plea bargain agreement between the prosecution and the public defender the day after a pre-trial conference on November 20th, Michael Young Jr. pled guilty to a lesser serious misdemeanor count of Assault Causing Bodily Injury.
According to records Young was represented by public defender Susan Flander, with Carlyle Dalen as the prosecutor in the case.
At the plea change hearing on November 21st presiding Senior Judge Gerald W. Magee approved the plea bargain application to amend the felony charge to a misdemeanor. Judge Magee ordered Young to pay a 315 dollar fine for the incident and granted him time served of 60 days in jail.
Michael Young was released from custody following the hearing. No restitution for the victim’s medical costs is recorded in the online financial records.
Young is no stranger to receiving plea bargain deals allowing felony charges against him to be reduced with little or no jail time.
In 2005 Young was charge by Mason City police with a Class D felony count of 3rd Degree Burglary. Judge Carlynn Grupp amended it to 3rd Degree Theft; $440.54 remains unpaid in the case.
Again in 2005 Young was charge by Mason City police with 2 counts of attempted 3rd Degree Burglary and Possession of Burglary Tools. Judge Carlynn Grupp dismissed 2 of the charges for Young to plead guilty to 1 count of Attempted 3rd Degree Burglary; $370.51 remains unpaid in the case.
In 2006 Young was charge by Mason City police with 3 Class D felony counts of Forgery. Judge Carlynn Grupp dismissed 2 of the charges for Young to plead guilty to 1 count of Forgery; $1468.21 remains unpaid in the case. $942.57 is still due to the victim in the case.
In 2007 Young was charge by Mason City police with a Class C felony count of Criminal Mischief. Judge Colleen Weiland amended it to 3rd Degree Mischief; $1066.63 remains unpaid in the case. $ 454.55 is still due to the victim in the case.
Again in 2007 Young was charged by Mason City police with a Class D felony count of 4th Degree Railroad Vandalism. Judge Colleen Weiland gave Young a 5 years suspended prison sentence and 6 months in residential treatment; $175.08 remains unpaid in the case.
There was a gap between those felonies after Young was sent to prison for violating probation.
There never going to be able to lock all these people up. Because taxpayers don’t want to pay for the prison’s and larger jails. I think they should send all the sex offenders to a remote island. There’s no cure for them anyway.
I see Mr. Dalen is not coming on here trying to defend his actions, or in this case lack there of. Was taken more time of work really in the bet interest of the public Mr. Dalen. How do you explain the lack of restitution for the medical bills, you would never make it in private pracice so you make it off the tax payers doing as little of your JOB as possible. The Globe is no longer the ONLY paper in town to sugar coat things for you.

What is this city coming to? people are getting to walk on crimes that they should be sitting in jail for I know that if it was me they would throw the book at me and lock me up. I have seen too many people that have a long list of crimes just walk out of the court house to do it again and then get set free again We need to fire all the judges and get some new ones in there.
What part of retention vote don’t bloggers here understand? You can’t fire judges until they come up for retention vote on the ballot unless they breach judicial ethics. I see a lot of comments about how the judges don’t put people away, but I also feel a lot of the responsibility goes to the lack of effort by our prosecutors. Can you please do a story on the lackluster performance of our prosecutors?

Dalen NEEDS to be ousted from his job. I would also like to see a story on ALL the rapes and sexual abuse charges against these sexual predators he makes deals with, or just lets walk free, and all the sexual assault cases he has sitting on the shelf to wait out the time. How many rapes and sexual assaults have happened this year alone? In the last month for that matter? And why do we hear nothing about it? If it wasn’t for North Iowa Today or North Iowa Mugshots we wouldn’t even know this is starting to become an epidemic in this town.
