Clear Lake man receives deferred judgment in sexual abuse case

A Clear Lake man has received a deferred judgment in a Class C felony count of 3rd Degree Sexual Abuse.

Nickolas David Kuhlemeier, age 21, was charged in January of this year after an investigation was conducted into the alleged sexual abuse of a 14 to 15 year old youth in Clear Lake. Kuhlemeier had been out on bond following his arrest while awaiting trial.

The case had been set for trial on September 25th, but a plea change hearing was requested the day before the trial.

At the sentencing hearing on Monday, November 26th, presiding District Court Judge Colleen D. Weiland handed down a deferred judgment on the 3rd Degree Sexual Abuse charge. Instead of serving any jail time Judge Weiland sentenced Kuhlemeier to serve 2 years of probation with the Iowa Department of Corrections.

Judge Colleen Weiland imposed the minimum $1,000 fine for the charge, but then suspended it. Kuhlemeier was ordered to pay $2087.34 in restitution and an additional $465.50 in court costs. His 10 percent cash bond posted in February was taken to pay part of the restitution in the case.

Judge Weiland extended a protective no contact order against Kuhlemeier an additional 5 years.

Under Iowa’s current sentencing laws Kuhlemeier is required to register as a sex offender for a period of 10 years.
