MASON CITY – According to a Mason City Police Department incident report, two officers made a traffic contact at 4 am Saturday morning in the 500 block of North Massachusetts Avenue. As a result of that contact 47-year-old Jose Maria Hernandez-Pazcual, of Mason City, was arrested.
Hernandez-Pazcual was booked into the Cerro Gordo County Jail at 5:43am after being charged with:
1 class D felony count of operating while intoxicated 3rd or subsequent offense
1 serious misdemeanor count of driving without a license
1 serious misdemeanor count of open container by driver
A no bond immigration hold has also been placed on Hernandez-Pazcual by U.S. Immigration and Customs Enforcement (ICE). ICE is the largest investigative arm of the Department of Homeland Security.
Court records show Hernandez-Pazcual was convicted of 1st offense OWI in May of 2002 in Cerro Gordo County following a traffic stop by Mason City Police Department.
Hernandez-Pazcual was then convicted of 2nd offense OWI in July of 2002 in Cerro Gordo County following a traffic stop by Mason City Police Department. In the 2nd OWI there court records show his employer at the time, Andrews Prestress, was ordered to withhold $50.00 a week from his paycheck to pay for fines and court costs in the case.
Jose Maria Hernandez-Pazcual has been arrested by Clear Lake Police, Mason City Police, Cerro Gordo County Sheriff’s Department on numerous driving related offences dating back to 2002.

He most likely was here on a work visa, hints why they were able to garnish his wages. A valid work visa does not mean he is a permanent resident, or what all you people would think of as a green card. With a work visa they are eligible to get a drivers license, which he clearly had lost due to previous charges. Work visas can be taken away as “easily” as they are given out. Anyone can be sent back to where they came from if they are not abiding by the law. And a 3rd owi will absolutely send you back. Permanent residents, “green card holders,” can also be stripped of their rights here if thry are not law abiding, and be sent back as well. They are not free and clear of anything, even if they apply for citizenship, which few and far do, they can also be stripped of thay in serious measure…inside terrorism, murders, etc. Everyone thinks they are so educated about the system, when in reality not many people in this area actually know the process.
They could take care of this problem by making E-Verify mandatory for every employer in Iowa. And slap big fines on the ones that hire them. They might deport themselves. Unless Obama can get them all on welfare. He would do it if they voted for him. He already gave thousands of them a work waiver to come and steal more jobs and have babies.

Did this guy have a legal green card in 2002? If not, why wasn’t his employer reported to ICE. I think he must have had a legal work permit of some sort in order for them to have a garnishment order for a paycheck. If not, he should have been deported and his employer would have been in trouble and possibly raided by ICE. And why is there an ICE hold now? Did his green card expire or was his status ignored before? I have heard that they get deported and come back to the same jobs within a few weeks. Is this guy still at the same job? And if so, and if this guy is illegal, why was he given a job that an American needs? I just want more information if it is available.
Obama wants to keep them all in the country long enough to vote. That is why Eric Holder was trying to sue Arizona for there use of voter ID.
