Man who escaped third degree sex abuse charge faces probation revocation

MASON CITY – A man from Iowa Falls who escaped a charge of 3rd degree sexual abuse from a May 29, 2011 incident with a minor is back in the slammer awaiting a hearing on whether his probation will be revoked for a second time.

Andrew Lloyd Spurgeon received a deferred judgement on March 26, 2012, in the 3rd degree sexual abuse case from Judge Stephen P. Carroll.  Carroll ordered Spurgeon to register as a sex offender for 10 years and perform 50 hours of community service and was placed on probation.  A contempt of court charge was dismissed.  In addition, Spurgeon negotiated a guilty plea for harboring a runaway (the minor) and received a $625 fine and 7 days n jail.

According to online records, Spurgeon was found guilty of violating the terms of his probation after a May 9th, 2012 incident and was placed in BeJe Clark Residential Facility on June 26th by Judge Dedra L. Schroeder.

Online records further indicate that Spurgeon committed another offense on August 24th which again violated his probation.  A warrant for Spurgeon’s arrest was issued on August 27th and he was booked into the Cerro Gordo County Jail that day at 4:48 PM.

Multiple calls to BeJe Clark this afternoon went unanswered.

Spurgeon will face a judge on September 25, 2012, for the probation revocation.

Spurgeon says on his public Facebook page that “just because i have made mistakes, doesnt mean that i should be judged by those mistakes. Everyone makes mistakes, the important thing is that you learn from them, but more importantly you become a better person from them. Now last year, a big mistake was made.  And because of that, i am judged apon the outlook on that situation. But Myself is here to make a statement. That doesn’t have any effect on the person that I am what so ever! Anyone can say what they want. I have not cared about that situation, I have put that in the past, because it is not going to drag down my future.”
