MASON CITY – A now-convicted local drug dealer will serve no jail time after District Court Judge Colleen D. Weiland sentenced Mason City drug dealer Timothy Lee Rucker for two class C felony counts of delivery of methamphetamine with 1,000 feet of a school, and one class C felony count of possession with intent to deliver MDMA (Ecstasy).
At the scheduled sentencing hearing on Tuesday, August 27th, Judge Weiland sentenced Rucker to three 10 year suspended prison sentences, one for each charge. Instead of prison Rucker was ordered to serve 3 to 5 years on probation with the Iowa Department of Corrections. Weiland imposed one $1,000 civil penalty before suspending two other $1,000 civil penalties. Rucker must also repay the public defender’s office for representation, court cost, and surcharges in the amount of $2,858.90.
Rucker had entered negotiated voluntary pleas of guilty to the three charges on July 16th, 2012.
Judge Weiland also approved the dismissal of additional counts brought on by the North Iowa Drug Task Force. Those counts being dismissed are listed in the online court record as:
One class C felony count of delivery of crack cocaine within 1,000 feet of a school.
One class C felony count of delivery of cocaine within 1,000 feet of school.
One class C felony count of delivery of methamphetamine within 1,000 feet of school.
One serious misdemeanor count of possession of crack cocaine.
One serious misdemeanor count of possession of cocaine.
One serious misdemeanor count of possession of marijuana.
The charges followed controlled buys of meth, crack cocaine, and cocaine from Rucker on July 28th and 29th, 2010, followed by two buys on August 10th and a single buy on August 26th . All the buys are alleged to of occurred within 1,000 feet of a school. On August 31st Rucker is accused of having possession of MDMA with intent to deliver along with possession of crack cocaine, cocaine, and marijuana.
Rucker had been out on pre-trial release nearly a year awaiting court under the supervision of the Iowa Department of Correctional Services following an order by District Court Judge Colleen D. Weiland to drop a $62,000 cash or surety bond requirement originally set by Magistrate Rolf Aronsen after Rucker spent several days on the run from local law enforcement.

North Iowa Drug Task Force and MCPD are trying to “make a deal” before the bust is even over, trying to get a bigger fish. What doesn’t happen is getting the bigger fish, because of knowing what and how to say shit that wants to be heard. All this happened in 2010 and after. So this thing above pretty much promised something; and to this date Shit Sitty has done nothing but go to the state everyone is bitching about. Tell of one significant; the MCPD has brought down but the locals. Most have “relocated” south and are still back and forth for visits. Stipulations are put in writing before any sentencing ever happens. I really can’t believe you all just want to point a finger at a judge. WAKE THE HELL UP!

I believe the judge can be an investigation on judges…. plus impeachment …I believe it by contacting our congress man or senate… it’s worth a try ….I believe it is article 1 of the constitution…

My sympathies to the North Iowa Drug Task Force. Why the heck should they ever bother to try to take down another dealer in River City when the charges get dismissed? You can bet there was no lack of evidence. From now on, I bet they only take down druggies when they can charge them with federal crimes that won’t get put before this crappy judge only to get bargained away or dismissed. There’s trouble in River City and it starts with a C!
It’s a game. The cops are doing their job, and the prosecutors / judges are doing theirs. Keep catching them and make deals to get the bigger fish. Who cares if this POS sits in jail, or not. Someone will be next in line to take his place. If his info turns out bad, he sits in jail so he’s going to talk. At least his dealing days in this area are over. Who’s going to supply him with drugs to sell after he’s been busted and spent so much time with the cops. The Welfare check he recieves will cost the taxpayers less than keeping this trash in jail.
I have no confidence that this district judge knows how to play the game correctly. Have there been any big fish caught as a result of this guy’s arrest a couple years ago? I sure hope they didn’t bargain him down without an arrest somewhere. It seems to me that should have been able to take out a whole network in exchange for what this guy got pleaded away.

what the hell is going on when someone can make a deal to not go to jail. sometimes things here in mason city are backwards .people who deal drugs of any kind need to be in jail for a very long time .there is no reason at all to cut deals with them even if they can help bring down others who do the same, they still need to serve time just for the act alone. everyone says that they want to clean up mason city but then we let things like this happen it time to stand up and really do somethings about all the drugs and act of violence if you do it pay the price and go to jail.stop the craziness now.

Sounds to me the Judge is involved in the drugs. Of course I wouldn’t say it is just her as I have seen it in other counties where they let them off. Where is our protection. Maybe they should just have them stand in the lunch line and distribute their drugs to make it easier.
I wonder if Judge Weiland will ever read this and offer some type of half assed explanation on her logic in giving this man suspended sentences. This crap is going to continue in Mason City until this Judge wises up and starts to do her job properly. How do we get rid of a judge???
Judges are subject to Retention Elections. In November, the two District Court judges up for retention are Davenport & Drew. Pay attention to the ‘back page’ on your ballot and look fore the Judge retention question(s) – and when Weiland’s name is there, Vote “NO” – if a majority of voters do that, she’s gone. That’s how to get rid of her.
So, Weiland’s name will be there this coming Fall? I want to make sure I don’t miss out on casting my vote to GET RID OF WEILAND!!!!!!!

Who says crime doesn’t pay. What a farce. Why even have laws if they are not going to be enforced. Maybe the judge is sleeping with him or something. All of this happened close to schools. What do you think he was doing there. Now this guy will just disappear laughing all the way.
And we wonder why there are so many drugs in our schools? With a sentence like this, doesn’t it just invite other drug dealers closer to our children?
