MASON CITY – Three subjects were spotted on railroad property by Union Pacific Railroad employees Wednesday in Mason City and arrested after Mason City police were called.
The arrests were made at about 4 PM near 19th Street SW and South Pierce intersection.
The three subjects were arrested and charged with criminal trespassing (Iowa code 716.7), a simple misdemeanor.
All three subjects remained in the Cerro Gordo County Jail Thursday.
Those arrested were:
Todd Vern Waters, 64
Rodney David Sykora, 69
Alexandra Molitor Waters, 24
SUBJECTS ARE INNOCENT UNTIL PROVEN GUILTY
1. what were they doing there in the first place?

The 3 trespassers were trespassing. The railroad does not need to have to watch out for idiots on the tracks. They have enough to do with their jobs. They are not a babysitting service! And big hoss, you sound dumber than a box of rocks. You better stay inside where it’s safe. Maybe you

As far as the railroad goes, they take every precaution, but it is a very dangerous jobs. Sometimes accidents happen, especially when you have a dangerous job. Thank God it doesn’t happen very often.

Oh, don’t let the looks fool you. They are obviously hard core criminals and won’t be getting out of prison for many decades. I’m surprised the SWAT team didn’t call in the USAF and take them out using 5 or 6 carpet bombing B-52’s for standing on railroad property. It’s unbelievable this heinous crime could happen in Mason City.

I am not sure where your sarcasm is based, however the Railroad companies take exception to trespassers as they are a huge liability.
As a rule, the general public has no clue about railroads or reasonable expectations about safety on or around their property.
And as perfectly said by ‘UP Employee’, gauche comments about the safety of railroad employees is ill times and incorrect.
The big deal is that its against the law. Big Hoss please refrain from the stupid jokes about RR employees not being safe, that’s in bad taste after we just lost a great man.

You obviously don’t read the news that much otherwise you would realize that a man that works for the UP was just killed last work, whom to my understanding was one of the safest workers there. So if one of their own can be killed, it is understandable why they don’t want other people out there. These guys don’t need to worry about non railroad employees being out there when their jobs is obviously already dangerous.

These three Hobos were bound for the Britt convention this weekend and got off the “West Bound” in Mason City by mistake. Dazed and confused they were soon apprehended.
Rumor has it that she is running for Queen of the Jungle. Aint she purdy.
So they were walking on Railroad property, don’t see the big deal. Tons of people do it all the time.
Who said it was a big deal? A simple trespassing charge. They will never show up for the hearing, so who cares?
If I walked all over your property (if you indeed own any), you would feel ill used. But property owners in this country have rights, and one of them is to exclude anyone and everyone they don’t wish to be on it.
In some places in the U.S. if you were seen trespassing, you could be shot without question.
In short sir, the Constitutional rights of a person are a big deal! Perhaps you are too small minded to notice.

At center of this is the Constitutional right to have and hold property. It allows a person to protect their property as they desire. And it also allows one to seek redress under the law when a person or persons violate that right.
It is not that I am an old fart, the view supports the property rights of everyone who has property. If you desire everyone to trample yours, that is OK. However, since I work hard to keep up the property, I don’t want that to happen.
With the case at hand, it is matter of liability and safety for the railroad.
Sorry observer, no place in the US gives you the right to kill a trespasser.
You may have the right to kill a burglar or anyone threatening you, but a simple trespasser, not at all.
And one of the portions of the constitution that you neglect to mention is the due process clause: with few exceptions (as stated above) no state has the right to authorize the killing of anyone without due process of law.
The consitution is a bit more than all property rights all the time.
