MASON CITY – On Monday, March 5th, 47-year-old Donya Marie Lee received a deferred judgment on a Class C felony charge of delivery of crack cocaine.
Donya was originally arrested on June 17th, 2011 by the Cerro Gordo County Sheriff’s Department for delivery of crack cocaine following a narcotics investigation.
Donya had spent much of the past nine months being pulled in and out of the Cerro Gordo County Jail on numerous warrants for violations of pre-trial release issues and failing to appear to court, each time being released without bond to the supervision of the Department of Corrections.
Donya was also charged with one count of accessory to murder following the shooting death of Brandon Crawford on August 9th that occurred in the Casey’s parking lot beside her home. That charge was later dismissed according to court records “in the interest of justice”.
Court records show on January 18th Donya had a plea change hearing on the delivery of crack cocaine charge and sentencing was then set for March 5th. At sentencing on Monday District Court Judge Stephen P. Carroll handed down a deferred judgment in the case. As part of the judgment Donya was directed to complete two hundred hours of community service, and will be on probation with the Iowa Department of Corrections for five years.
A deferred judgment refers to a postponed or delayed judgment. In a deferred judgment, the court gives a defendant an opportunity to complete a probationary period before sentencing and prior to any entry of conviction. If the defendant successfully completes probation at the conclusion of the probationary period the court will review the defendant’s file and may dismiss the charges against him/her.
If the defendant does not follow all of the terms and conditions of probation the court may enter the conviction and sentence the defendant accordingly. Normally, if a person pleads guilty or is found guilty of new criminal charges the case proceeds to sentencing. When a deferred judgment is obtained the case is frozen between the guilty plea and sentencing.

Did occur to any of the posters that she will likely be testifying in Crawford’s murder trial and a deal was made on that basis?
Did it ever occur to you if Donya’s House of Crack wasn’t their murders wouldn’t have a front porch to hang out on and Beje Clark escapees wouldn’t have a crack house to hid the gun in after the murder.
Since this revolving door got a deferred sentence, how long before she’s caught doing something again? Will the sentence be made and dismissed? Probably. We need people out on the streets like this so we have some excitement in this town. Is that what the judges are thinking? Maybe it keeps the publics mind off their bad judging.
I don’t think anyone is falsely judging this person. She gets arrested, gets let go, gets arrested, gets let go. She was involved in a murder, get’s let go. She needs to be in jail and off the streets. Sorry if you feel that’s judging her, but how many strikes can she be allowed?

This is the second article about meth/crack dealers getting off this week. It’s ridiculous. Who oversees the judges in Cerro Gordo County? When did it become “okay” to be a drug dealer? Why aren’t these people in jail?
It’s a shame that people get hooked on drugs. If only they could understand what the chemicals do to their brains and that, after a while, there will be no more pleasure. Just apathy and anger. There are no “happy” chemicals left in the brain.
I’m reading a book called Methland that is mostly about Oelwein and what meth did to that town and how they are recovering. I highly recommend it. It’s available on Amazon.com. It explains what meth does to the brain chemicals and why it quits working.

But the court system is not helping her by letting continue to live this lifestyle. Send her to jail and let her get rehab while she is in jail. Maybe some jail time will trigger something in those damaged brain cells.
She is a Rat, Mason City lets this type of stuff go on. No wonder we got these type of drug dealers an walfare soaking people here. Oh and whos paying for that big Trash bin in front her house ? Its been there for months, let me guess the Mason City Tax payers!!
It is my understanding that Casey’s bought the property and plans to demolish it. The trash bin belongs to Russ Hardy’s business. He wanted to purchase the property, but wasn’t able to. Instead, he made a deal with Casey’s to remove the trash from the house in exchange for some appliances, furnace, water heater, and central air unit. At least, that’s what I’ve heard from a couple of guys there were there cleaning it out one day.

For one thing, they let her out because she snitched. Pay attention folks because now you’ll be reading about a lot more druggies getting busted soon.
