Iowa man shoots house intruder dead; use of force justified

SPENCER, IOWA – An Iowa man shot a house intruder dead, and authorities say the use of force was justified and no charges will be filed in the incident.

The Clay County Attorney’s Office has announced that charges will not be filed in regards to the September 1, 2017 shooting death of Nicolas Bandomo.
On September 1, 2017, at 12:39 AM, the Clay County Communication Center dispatched emergency personnel to 819 E 12th Street in Spencer, Iowa for a gunshot victim. When personnel arrived on scene, they located 30-year-old Nicolas Bandomo of Albert City, Iowa. Bandomo was transported to the Spencer Hospital and later transferred to Avera McKennon hospital in Sioux Falls, South Dakota where he died.

An investigation conducted by the Spencer Police Department, Iowa Division of Criminal Investigation, and Clay County Attorney’s Office determined that Bandomo illegally gained entry into the occupied residence of 810 E 12th Street in Spencer. On the date of shooting, Bandomo was prohibited from making contact with the residents at the home by multiple protection orders. Andres Ramos, 26, of Sibley, fired a single shot, striking Bandomo while Bandomo was inside the residence. Bandomo fled the residence to 819 E 12th Street, where emergency personnel found him.

The investigation concluded that Ramos was justified in using deadly force against Bandomo under Iowa law.
