Mason City School Board struggles to make legal votes, appointments

At the regular meeting on May 18, 2015, the Mason City Community School District Board of Education accepted the resignation of Robert Thoms, and then proceeded to fill the vacancy created by Mr. Thoms’ resignation. The person identified by the Board to fill the vacancy was Paul DeRoy.

The Board announced Mr. DeRoy’s appointment, but failed to first pass a motion to approve his appointment prior to swearing Mr. DeRoy in, which deems his appointment not legally effective. In order to correct this oversight, the Board will hold a special session on Thursday, May 28, 2015, at 5:30 p.m. and the Board will take action at that time to appoint Mr. DeRoy as a member of the Mason City Community School District Board of Education.

Considering that Mr. DeRoy was not legally appointed as a Board member on May 18, 2015, the votes which he cast at the meeting on May 18, 2015, cannot be counted. One of the votes that Mr. DeRoy cast was a vote on the motion to elect Mr. Warren as Vice-President of the Board. At the time that the votes on this motion were counted, there was a tie vote and so the motion failed. Since Mr. DeRoy’s vote on that motion should not have been counted, the Board is required to recalculate the vote on the motion to elect Mr. Warren as Vice-President. When Mr. DeRoy’s vote is excluded, the vote on the motion changes from a tie vote to a 3-2 vote in favor of the motion to elect Mr. Warren. Board Secretary Ramona Jeffrey and Board President Mark Dodd administered the oath of office to Mr. Warren and he was sworn in as Vice-President on May 27, 2015, in the Administration Building offices as per the requirements of Board Policy 202.2 – Oath of Office.
