DES MOINES – A Clear Lake man’s conviction for drunk driving has been upheld by the Iowa Court of Appeals.
On January 3, 2013, William Burns, age 59, was involved in a three car accident in Clear Lake, which rendered his car inoperable. After arriving at the accident scene, the officers determined Burns was at fault, and he was arrested and charged with first offense operating while intoxicated. He was later found guilty and ordered to pay $3,127.50 in fines and court fees.
Burns appealed the district court’s judgment and sentence for operating while intoxicated. He argued the State did not did satisfy the exact conditions for invoking implied consent. The appeals court disagreed, and upheld his conviction. Burns was represented by Clear Lake attorney Colin Murphy.
