Garner man violates terms of pre-trial release with alleged hate crime

MASON CITY – A man from Garner already facing serious charges after an incident at Clear Lake earlier this month was arrested on a new charge described as a hate crime by Garner police.

Joshua L. Engstler, age 19, was booked into the Cerro Gordo County Jail at 1:28 AM Tuesday morning, accused of violating his pre-trial release in connection with an incident in Clear Lake on July 5, 2014. Engslter is charged by Garner police of criminal mischief in the fifth degree – hate crime – related to a criminal trespassing incident on May 24th, 2014. He is being held on $2,500 cash-only bond. He also faces a second trespassing charge, also brought by Garner police.

Engstler stands charged with interference with official acts, minor consumption, no proof of fishing license, reckless operation of a boat (all simple misdemeanors), two counts of prohibited operations (serious misdemeanors), and theft in the second degree (felony D) after he was arrested on July 4th at Clear Lake. At least four law enforcement agencies responded to a situation that evening on the lake involving Engstler. According to a report, Engstler was intoxicated, combative and had allegedly stolen a boat at or near 6490 South Shore Drive. Clear Lake police, Iowa DNR officers, the Iowa State Patrol and Cerro Gordo deputies managed to get Englster under control before he was arrested. He had been released from jail pending a July 25th hearing and was under the supervision of the Iowa Department of Corrections.
