Clear Lake man arrested again for violating no contact order

NIT – He is now accused four times of violating a no-contact order with a Mason City woman, this Clear Lake man, who is also accused of felony domestic assault strangulation against the same alleged victim.

Daniel Lee Franken of Clear Lake, age 24, was arrested Saturday morning, after police were called to the 500 block of 21st Street SE at about 2:47 AM.  Mason City police and Cerro Gordo deputies responded and investigated.  Franken was soon caught and taken to the Cerro Gordo County Jail by deputies, charged with trespassing and violating the no-contact order with an alleged victim of his of domestic assault involving strangulation.  He was booked at around 4:40 AM, and remained held there on $5,000 cash-only bond.

A Mason City woman filed a petition for relief from domestic abuse in court against Franken on January 10, 2014.  Since then, Franken has been accused of violating the protective order on Jan. 18 (dismissed); February 23 (dismissed); March 23 (this incident involved felony domestic assault with strangulation; no court date set) and now April 19.

Mason City police told NIT that on Sunday, March 23, 2014, a domestic assault was reported in Mason City allegedly involving Franken and the same woman at the same address as the incident on April 19. The assault allegedly took place at a Mason City home owned by parents of the accuser, at the 500 block of 21st Street SE. Investigators determined that probable cause existed in verifying the assault, and police began searching for Franken. They later located him in Clear Lake at his parent’s house and arrested him.  He pled not guilty on April 9.

Franklin beat a third degree harassment charge on March 25, after the trial was postponed four times.  The alleged victim, who is a young lady from Clear Lake, told NIT Saturday that “he had a good lawyer” and that she doesn’t know “how much trouble he will get in before he gets it. He’s an alcoholic.  I know he has guns too.”
