Mason City man gets probation in credit card caper but back in jail for failing to appear in court

MASON CITY – A Mason City man is in jail after a warrant was issued for his arrest for failing to appear in court.

David William Garber, age 32, was set to appear in court on  November 7th for a contempt hearing related to a 4th degree criminal mischief case in which he was found guilty, but he did not show up.  A warrant was then issued for his arrest by judge Gerald Magee.  He was booked into the county jail on the afternoon of November 18th.  Garber still owes the court $1,582.66 in that case.

Garber negotiated a plea with the court on a charge of unauthorized use of a credit card and on November 9th was given 40 hours of community service and probation by Judge Carlynn Grupp.  Both a $625 fine and 2 year jail term were suspended.

Garber is being held in the Cerro Gordo Conty Jail at this time on $1,000 cash bond.

Funny someone I know had a credit card fraud charge & it was dismissed… hmmmmm…. No fine, nothing. I had to pay it all myself when I never authorized the charge. Guess it depends on what judge you get.
