Local man escapes attempted rape charge

MASON CITY – Following negotiated guilty plea agreements to lesser charges, an assault with intent to commit sexual abuse charge has been dismissed at a plea change hearing for 21-year-old Jordan Jerome Holmes.

Holmes was arrested by Mason City Police Officers for an incident that occurred on April 29th, 2012 in which he was charged with an aggravated misdemeanor count of assault with intent to commit sexual abuse, a misdemeanor count of false imprisonment, and a simple misdemeanor count of domestic abuse assault.

Holmes had pled not guilty with a trial was set for June 26th in Cerro Gordo County District Court. Court records show just 5 days before the scheduled trial a plea change hearing was set up for June 27th.

At the plea change hearing the simple misdemeanor domestic abuse assault was amended to assault and Holmes was given two days in jail with credit for time served. For the false imprisonment charge Holmes received a 180 suspended prison sentence, and one year of probation. Sentencing District Court Judge Rustin T. Davenport also handed down a $315 fine, $110.25 surcharge, and $270.50 in court costs and lawyer fees.

The most serious charge of assault with intent to commit sexual abuse was dismissed on application by Judge Davenport on June 28th, the day after sentencing on the lesser charges.

SUBJECT IS INNOCENT UNTIL PROVEN GUILTY
